SC300 Prospective Spouse Visa

This visa allows applicants to enter Australia and marry within a nine-month validity period from entry. Once married and meeting the relevant criteria, visa holders can apply for an SC820 Partner visa. After two years (potentially less in certain circumstances) with the relationship ongoing, SC820 holders may apply for the SC801 permanent visa.

Sponsor Requirements

The sponsor (fiancé) must be an Australian citizen, Permanent Resident, or eligible New Zealand citizen.

Key Eligibility Criteria

  • The couple must have met and be personally known to each other (internet meetings alone don’t qualify)
  • Both parties must genuinely intend to marry within the validity period
  • Both must genuinely intend to live together as spouses
  • They must be able to marry under Australian law
  • The applicant must be outside Australia when the visa is granted
